Judgment text excerpt

The Supreme Court upheld the High Court's dismissal of the Writ Petition challenging the award of the Industrial Court under the Maharashtra Raw Cotton (Procurement, Processing & Marketing) Act, 1971. The Court clarified that the definition of 'Cotton Season' in Section 2(j) was implicitly considered in the earlier judgment of Maharashtra State Co-operative Cotton Growers' Marketing Federation Ltd. v. Employees Union, [1994] Supp 3 SCC 385. The Court concluded that the earlier decision was not in error regarding the definition of seasonal employees under the Cotton Scheme.
