The Supreme Court upheld the conviction of Gian Singh under Section 3(2)(i) of the Terrorists and Disruptive Activities (Prevention) Act, 1985 and Section 302 read with Section 34 IPC for the murder of Sant Harchand Singh Longowal. The Court noted that the Special Judge had no alternative sentence under TADA 1985, leading to a death sentence. However, considering the appellant's prolonged incarceration of over 14 years, the Court indicated that the question of sentence could be revisited if the conviction was upheld.
