Judgment text excerpt
The Supreme Court ruled that the appellant, a teacher, was entitled to the pay scale of Rs.1640-2900 as per the qualifications prescribed by the NCERT and the circulars issued by the Directorate of Education. The Court held that the denial of the higher pay scale based on the argument of insufficient qualifications was unjustified, as the appellant possessed the requisite qualifications for the post. The Court set aside the Bombay High Court's dismissal of the writ petition and directed the authorities to grant the appellant the appropriate pay scale from the date of his appointment.
