The Supreme Court held that the suit for possession filed by the legal representative of the original plaintiff, R.C. Chopra, was maintainable despite the dismissal of the earlier eviction petition under Section 13 of the East Punjab Urban Rent Restriction Act, 1949. The Court clarified that the legal rights of the purchaser are not extinguished by the dismissal of the earlier eviction proceedings, and the suit was filed within the limitation period as per Section 47 of the Code of Civil Procedure. The Court reversed the High Court's decision and restored the trial court's decree for possession.
