Judgment text excerpt

The Supreme Court clarified that there is no conflict between the judgments in Rajbhar's case and Pushpa's case regarding the consideration of representations made by a detenu against detention orders. The Court held that the detaining authority and the Advisory Board had properly considered the representations made by the petitioner, and thus the order of detention was upheld. The Court dismissed the writ petitions challenging the detention, affirming the correctness of the law laid down in Rajbhar's case under Article 21 of the Constitution of India.
