The Supreme Court upheld the Bombay High Court's decision to quash the Court Martial proceedings against Himmat Singh Chahar, who was found guilty under Section 354 IPC and Section 77(2) of the Navy Act, 1957. The High Court determined that the evidence presented, particularly that of the complainant Mrs. Nirmala Sharma, lacked credibility and did not substantiate the charges against the respondent. Consequently, the Court ruled that the conviction and subsequent punishment were not warranted, thereby reinstating the respondent's position.
