Judgment text excerpt

The Supreme Court interpreted Section 4(1)(h) of the Orissa Land Reforms Act, 1960, clarifying that possession of land on the date of vesting is not a prerequisite for declaring a person as a Raiyat. The Court upheld the High Court's findings that the requirements for Raiyat status include holding land in a vested estate and being a temporary lessee in personal cultivation. The appeal was partly allowed, confirming some declarations of Raiyat status while directing the Board of Revenue to reconsider others.
