The Supreme Court examined the appeal of an Advocate suspended for two years by the Bar Council of India for professional misconduct under the Advocates Act, 1961. The Court found that the allegations against the appellant, involving a hand loan of Rs.3,000/- taken after a compromise in a civil suit, did not constitute professional misconduct as the appellant was acting in a personal capacity, not as an advocate.
