The Supreme Court upheld the conviction of the appellant under Section 409 IPC and Section 5(2) read with Section 5(1)(C) of the Prevention of Corruption Act, 1947 for misappropriating Rs. 52,465.37 belonging to the Government while serving as Managing Director of Assam Agro Industries Development Corporation Ltd. The Court found that the appellant unlawfully retained government money and acted dishonestly, despite his claims of inadequate staff and moral responsibility. However, considering the appellant's age and health, the Court imposed a sentence of less than the minimum prescribed.
