The Supreme Court addressed the entitlement of erstwhile landholders to reallotment benefits under Notification No. 71 dated 25th February 1941, determining that the notification, if issued by the Ruler of Bhopal, holds legal force. The Court also examined the implications of non-payment of tractorization charges under the Bhopal State Reclamation and Development of Lands (Eradication of Kans) Ordinance, 1949, and the Bhopal Reclamation and Development of Lands (Eradication of Kans) Act, 1954, which were previously deemed ultra vires. The Court held that the appellant is entitled to reclaim his land due to the illegality of the notices issued under the Ordinance and the Act.
