The Supreme Court addressed the failure of the State of Kerala to implement the directions from Indira Sawhney v. Union of India regarding the identification of the 'creamy layer' among Backward Classes. The Court found the Kerala State Backward Classes (Reservation of Appointments or Posts in the Services under the State) Act, 1995 to be discriminatory and violative of Articles 14 and 16 of the Constitution. The Court appointed a High Level Committee to identify the creamy layer and directed the State Government to cooperate with the Committee's efforts.
