Judgment text excerpt

The Supreme Court held that under Section 10(3)(a)(i) of the Tamil Nadu Building (Lease and Rent Control) Act, 1960, a landlord can seek eviction if they require the premises for their own occupation and are not occupying another residential building. The Court found that the High Court erred in concluding that the landlord's desire to live separately from his father did not constitute a bona fide need for the premises. The Court reinstated the eviction order, emphasizing that the High Court exceeded its revisional jurisdiction under Section 25 of the Act by overturning the concurrent findings of fact by the lower courts.
