The Supreme Court held that under Section 10(4)(i) of the A.P. Building (Lease, Rent & Eviction) Control Act, 1960, a tenant engaged in essential services cannot be evicted unless the landlord is also in such employment. The Court found that the tenant's transfer to a different town does not negate this protection, as the tenant was still employed in an essential service. Consequently, the High Court's reversal of the eviction order was upheld, affirming the tenant's right to remain in the premises.
