The Supreme Court held that the detention order under Section 3 of the Conservation of Foreign Exchange and Preservation of Smuggling Activities Act, 1974, was vitiated due to undue delay in its issuance, as it was passed 11 months and 15 days after the detenu's alleged smuggling activities. The Court found that the State Government failed to provide a satisfactory explanation for the delay, rendering the detaining authority's satisfaction regarding the need for immediate detention not genuine. Consequently, the Court quashed the detention order and ordered the immediate release of the detenu.
