Judgment text excerpt

The Supreme Court held that the rejection of nomination papers of respondents Rajendra Mahto and Ashok Kumar Srivastava was improper under Section 10 of the Representation of the People Act, 1951, which disqualifies only managing agents, secretaries, or managers of companies. The Court clarified that both respondents held non-executive posts at Bokaro Steel Plant and thus were not disqualified. The Court set aside the High Court's decision and upheld the election of the appellant.
