The Supreme Court ruled that under Section 4 of the Impartible Estates Act, 1904, the Zamindar had no authority to alienate impartible property beyond his lifetime, and such alienations must be for the benefit of the family. The Court held that the alienations made by the last Zamindar of the Punganur Estate were not binding on his sons after his death in 1965, as they were not for legal necessities. The Court affirmed the right of the sons to seek partition and separate possession of their share post the estate's abolition under the Madras Estate (Abolition and Conversion into Ryotwari) Act, 1948.
