Judgment text excerpt

The Supreme Court addressed the issue of seniority and pay fixation for judicial officers in Andhra Pradesh under the States Reorganisation Act, 1956. It held that the provisions of Fundamental Rule 26(aa) and Rule 40(aa) of the Hyderabad Civil Services Regulations do not apply to cases under the Act, thereby affirming that notional promotions do not entitle officers to arrears of salary if they did not actually hold the higher post. The Court upheld the High Court's decision that monetary benefits arising from notional promotions are limited to periods of actual duty in the higher post.
