Judgment text excerpt

The Supreme Court dismissed the appeal by the Union of India against the Railway Rates Tribunal's decision regarding siding and maintenance charges under Section 41(1)(c) of the Indian Railways Act, 1890. The Court found that the issues had become academic due to the closure of the siding in 1996, and thus refrained from interfering with the tribunal's findings on the reasonableness of the charges. The Court left the method of calculation of these charges open for future consideration, with no order as to costs.
