Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, stating that the tenant was in arrears of rent and the Rent Act did not apply as the shop was first assessed for house tax on 1.4.1982, making it ineligible for protection for 10 years. The Court affirmed the lower courts' decisions, concluding that the tenant's claim of reduced rent was unsubstantiated and the eviction was justified. The appeal was dismissed under Article 136 of the Constitution of India.
