The Supreme Court examined whether the respondents could be classified as tenants under Section 4A of the Kerala Land Reforms Act, 1964, as amended by Act 35 of 1969. The Court held that the continuous holding of land by the mortgagee for a period of fifty years suffices for tenant status, irrespective of the number of mortgages. The Court upheld the lower court's decision that the respondents had held the land continuously for over fifty years, thus denying the appellant's claim for redemption of the mortgage.
