The Supreme Court upheld the Central Administrative Tribunal's decision directing the appellant society to consider the respondent's promotion to the higher grade of Scientist (senior scale) based on the five-yearly assessment scheme in effect at the time of his eligibility in 1987. The Court emphasized that the respondent's assessment should have been acted upon despite the introduction of a new Career Assessment Scheme, which did not retroactively affect his eligibility. The Court ordered the appellant to pay the respondent the revised salary and any arrears due from January 13, 1990, when he was promoted.
