Judgment text excerpt

The Supreme Court upheld the Andhra Pradesh High Court's decision that the Circulars issued by the State Bank of India on 28.1.1987 and 7.3.1987 violated Section 9-A of the Industrial Disputes Act, 1947, which protects employees' rights to participate in union activities and elections. The Court established that the bank's restrictions on employees contesting elections without prior permission were unreasonable and infringed upon their rights. Consequently, the Circulars were set aside, affirming the employees' right to contest elections without undue restrictions.
