The Supreme Court upheld the dismissal of the appellant's appeal regarding his promotion and subsequent disciplinary actions. The Court found that the appellant was not eligible for promotion to the post of Superintendent in 1959 as he was only a Lower Division Clerk (L.D.C.) and there was no evidence of a vacancy. The Court also ruled that there was insufficient material to support claims of malafides against the officer who issued the cancellation order. Consequently, the appeal was dismissed with no order as to costs.
