The Supreme Court ruled that the appellant, a deceased railway employee, was entitled to salary for the period from 20.2.81 to 17.5.88, as the order of transfer that led to his suspension was quashed by the courts. The Court emphasized that since the transfer order was illegal, the disciplinary proceedings based on it could not deny the appellant his rightful wages. The Court held that the legal representatives of the deceased appellant were justified in claiming the salary, thereby reversing the decision of the Appellate Authority which had denied the salary claim.
