Judgment text excerpt

The Supreme Court addressed the applicability of the Land Acquisition (Amendment) Act, 1984 to land acquisition proceedings under The Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965. It held that the amendments to Sections 23(2) and 28, which increased solatium from 15% to 30% and interest from 6% to 9% and 15%, are applicable to the acquisition process initiated by the Parishad. The Court affirmed the enhanced compensation provisions, thereby ensuring fair compensation for landowners affected by the housing scheme.
