The Supreme Court held that the determination of surplus land under the Punjab Security of Land Tenures Act, 1953, and the subsequent allotment to landless persons conferred indefeasible rights that could not be revoked without due process. The Court found that the High Court erred in allowing the heirs of the original landholder to claim rights under the Haryana Ceiling on Land Holdings Act, 1972, as the surplus had already been vested in the State prior to the landholder's death. The Court upheld the original surplus declaration and dismissed the High Court's order for re-determination of surplus under the Haryana Act.
