The Supreme Court held that under Section 14(2)(ii) of the Himachal Pradesh Urban Rent Control Act, 1987, a landlord can evict a tenant if the tenant has sublet the premises without the landlord's consent. The Court found that the appellate authority and the High Court erred in their appreciation of evidence, as the landlord failed to prove that the tenant had sublet the premises to another party. Consequently, the Supreme Court upheld the trial court's decision dismissing the eviction petition, ruling in favor of the tenant-appellants.
