The Supreme Court held that the Central Administrative Tribunal erred in granting stepping up of pay to the respondents, as they were not entitled to it under the Circular dated 4.11.1993 issued by the Government of India. The Court clarified that stepping up is not applicable when a junior officer receives higher pay due to advance increments or ad hoc promotions, as was the case with B.C. Mishra. Consequently, the Court allowed the appeals and set aside the Tribunal's orders, reaffirming the principles established in Union of India & Others Vs. O.P. Saxena (1997 (6) SCC 360).
