The Supreme Court held that the death of a licensee does not abate proceedings under Section 41 of the Presidency Small Cause Courts Act, 1882. The Court distinguished the views of the Madras High Court in M. Ranganatham Pillai v. T. Govindarajulu Naidu, stating that the right of reversion survives for the licensor and is not a personal cause of action that dies with the licensee. The Court upheld the view of the Calcutta High Court and the Bombay High Court, affirming that ejectment proceedings enforce property rights and do not terminate upon the death of a party.
