Judgment text excerpt

The Supreme Court held that the review jurisdiction under Order 47 Rule 1 CPC is limited to correcting errors apparent on the face of the record and cannot be used to challenge the correctness of a prior order on merits. The Court found that the review petition filed by the judgment debtors did not meet the criteria for review, as it failed to identify any such error. Consequently, the Court set aside the order of the High Court that had reversed the earlier decision, thereby reinstating the original order of the Executing Court.
