Judgment text excerpt

The Supreme Court addressed an appeal concerning the liability for damages awarded by the National Consumer Disputes Redressal Commission under the Consumer Protection Act. The Court held that while the appellant was liable for not delivering the vehicle in good condition as per warranty, a deduction of 1/3rd of the compensation was warranted due to the extensive use of the vehicle (over 65,000 Kms) after the defects were reported. The Court confirmed the remaining amount awarded by the Commission, thereby partially allowing the appeal.
