Judgment text excerpt

The Supreme Court upheld the High Court's ruling that Section 21 of the Mamlatdar’s Court Act, 1906 does not prescribe a limitation period for executing eviction orders. The Court clarified that in the absence of a specific limitation, the general law of limitation under the Limitation Act, 1963 is excluded, allowing for execution at any time. The appeal was dismissed as the order of ejectment had become final and the arguments presented by the appellant were found to be without merit.
