Judgment text excerpt

The Supreme Court ruled that children of Muslim parents are entitled to maintenance under Section 125 of the Cr. P.C. until they reach majority or can maintain themselves, irrespective of the provisions of the Muslim Women (Protection of Rights on Divorce) Act, 1986. The Court held that the right to maintenance for children is not limited to the two-year period specified in the 1986 Act, affirming the lower court's decision to grant maintenance to the children. The Court clarified that the provisions of the 1986 Act do not affect the rights of children under Section 125 Cr. P.C.
