Judgment text excerpt

The Supreme Court addressed the applicability of Order XXI Rule 1(2) of the Code of Civil Procedure in relation to claims under Section 110(c) of the Motor Vehicles Act, 1939. The Court held that the appellant Corporation was obligated to inform the decree holders about the deposit of the decretal amount, and thus, the decree holders were entitled to interest from the date of deposit until they were notified. The judgment confirmed the Tribunal's decision to award interest at 12% from June 26, 1986, to April 19, 1989.
