The Supreme Court dismissed the appeal concerning the cancellation of a lease granted to the appellants, which was initially executed on December 5, 1994, and expired on December 5, 1995. The Court noted that the lease was cancelled by the Commissioner on February 17, 1995, but the State Government later set aside this cancellation. However, the High Court stayed the Government's order, leading to third parties being inducted for excavation work. The Court held that due to the intervention of third-party rights, it could not extend the lease period for the appellants and directed the refund of Rs. 6,30,000/- to them instead.
