Judgment text excerpt

The Supreme Court dismissed the Special Leave Petition (C) No. 1527 of 1997 as withdrawn, noting that an appeal against the decree had already been filed in the City Civil Court, Madras. The Court clarified that the appeal pending in the City Civil Court cannot be transferred to the Arbitration Board due to jurisdictional limitations, and directed that the award from the arbitrators be submitted as additional evidence under Order XLI, Rule 27 of the Code of Civil Procedure, 1908. The Principal Judge is instructed to consider the arbitrators' decision when disposing of the appeal on merits.
