The Supreme Court held that the dying declaration recorded by the judicial magistrate is admissible under Section 32(1) of the Evidence Act, and can form the basis for conviction even in the absence of corroborative evidence. The Court found that the High Court erred in dismissing the dying declaration as unreliable and in holding that the recovery of the pistol was inadmissible under Section 27 of the Evidence Act. The Court overturned the High Court's acquittal and reinstated the conviction of the respondent for murder under Section 302 IPC, sentencing him to life imprisonment.
