Judgment text excerpt

The Supreme Court held that the age of superannuation for the respondent, as prescribed by the Jind State Civil Service Regulations, 1945, was 62 years and continued to be applicable even after the integration into PEPSU and subsequently into the State of Haryana. The Court found that the trial court's dismissal of the respondent's suit was erroneous as the age of superannuation constitutes a condition of service that was preserved under the Covenant. The appeal was dismissed, affirming the decision of the Additional District Judge that the respondent was entitled to continue in service until the age of 62 years.
