Judgment text excerpt

The Supreme Court held that under the Requisition and Acquisition of Immovable Property Act, 1952, claimants are not entitled to solatium and interest as these are not provided for in the Act. The Court reaffirmed its decision in Union of India v. Hari Kishan Khosla, stating that the arbitrator lacks jurisdiction to award solatium and interest. Consequently, the appeal was allowed to the extent of the payment of solatium and interest, while upholding the compensation determined at Rs.1,000 per canal.
