Judgment text excerpt

The Supreme Court addressed the issue of pay disparity among Loco Running Supervisors promoted before and after January 1, 1986, under Rule 1316 of the Indian Railway Establishment Code. The Court held that the pay of employees promoted after this date, which included a thirty percent addition to their basic pay due to the revised pay scales, could not be less than those promoted earlier. Consequently, the Court ordered the stepping up of pay for the respondents to ensure equality with their counterpart promoted later, thereby reinforcing the principle of equal pay for equal work.
