The Supreme Court upheld the decision of the Allahabad High Court regarding the appointment of respondent No. 4 under the Uttar Pradesh Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974. The Court held that the rules override other recruitment norms and mandated that respondent No. 4, being qualified and entitled to the post, should have been appointed as a clerk instead of the appellant. Consequently, the promotion of the appellant was quashed, and respondent No. 4 was directed to be appointed to the vacant clerk position effective from 12.5.1990.
