The Court held that the rules override other recruitment norms and mandated that respondent No. 4, being qualified and entitled to the post, should have been appointed as a clerk instead of the appellant. Consequently, the promotion of the appellant was quashed, and respondent No. 4 was directed to be appointed to the vacant clerk position effective from 12.5.1990.
