Judgment text excerpt

The Supreme Court held that under the Enemy Property Act, 1968, a person who has migrated to Pakistan and acquired citizenship ceases to have any rights in Indian property. In this case, Mohd. Marghoob Siddiqui, having become a citizen of Pakistan, had no valid title to the property after his mother's death, rendering the subsequent sale to the appellants void. Consequently, the appellants could not claim any title to the property, and the appeal was dismissed.
