Judgment text excerpt

The Supreme Court upheld the assessment made by the Assessing Authority under Rule 38(3) of the Rajasthan Mineral Concession Rules, 1986, affirming that the circular issued by the Government on October 17, 1987, does not contravene the statutory rules. The Court clarified that the assessment method allows for a best judgment assessment when the licensee fails to provide actual weighment slips, and the authority can assess up to 150% of the maximum safe weight for minerals carried. The Court concluded that the assessment procedure is just, fair, and reasonable, and does not violate the principles of the Rules.
