The Supreme Court set aside the Punjab & Haryana High Court's order declaring the respondents as freedom fighters entitled to pension under the Freedom Fighters’ Pension Scheme. The Court held that the High Court overstepped its jurisdiction by re-evaluating the evidence which was the prerogative of the Government. Citing Mukund Lal Bhandari & Ors. Vs. Union of India & Ors. [(1993) Supp. 3 SCC 2], the Court emphasized that the sufficiency of proof lies with the Government, not the judiciary. Consequently, the appeal was allowed and the writ petition dismissed without costs.
