Judgment text excerpt

The Supreme Court addressed the issue of whether S.N. Kacker, after completing his tenure as Director of AIIMS, could revert to his previous position as Professor and Head of the ENT Department. The Court held that upon the expiry of his five-year tenure, he was entitled to revert to his original post as the Director's position was not permanent, as per Regulation 22 of AIIMS. The Court concluded that Kacker did not cease to hold his position as a Professor during his tenure as Director, thus allowing him to return to his previous role until superannuation.
