The Supreme Court dismissed the special leave petition, affirming that the judgment in State of Orissa vs. Adwant Charan Mohanty does not require reconsideration. The Court clarified that employees categorized as Class III and above, despite being skilled, are not entitled to superannuation at 60 years, but must retire at 58 years, while Class IV employees are entitled to the 60-year benefit. The Court found no conflict between the judgments in Mohanty’s case and A.K. Dutta’s case, as the latter followed the former.
