The Supreme Court, in an appeal under Section 19 of the Terrorist and Disruptive Activities (Prevention) Act, 1987 (TADA), overturned the acquittal of the accused for murder under Section 302 IPC read with Section 34 IPC. The Court established that the prosecution had sufficiently proved the involvement of the accused in the murder of Bhag, supported by eyewitness testimonies and forensic evidence. The Court held that the acquittal by the Designated Court was erroneous and convicted the accused under the relevant sections.
