The Supreme Court upheld the decision of the Kerala High Court, affirming that the original appellant-defendant no. 2 was not a deemed tenant under Section 6C of the Kerala Land Reforms Act, 1963, as amended by the Kerala Land Reforms (Amendment) Act, 1979. The Court ruled that the Lease Deed executed on 10th January 1969 was invalid under Section 74 of the Act, which prohibits the creation of leases after 1.4.1964. Consequently, the appeal was dismissed, confirming the partition and possession rights of the plaintiffs.
