Judgment text excerpt

The Supreme Court examined the validity of a will executed by Najaf Khan, which purported to create a wakf after the death of Smt. Musomat Kariman. The Court held that the will did not create a valid wakf as it was contingent upon the death of Kariman without heirs, violating the principles of Mohomedan law as outlined in Sections 174 and 191. Consequently, the Court upheld the concurrent findings of the lower courts that the will was void and the wakf was not established.
