Judgment text excerpt

The Supreme Court addressed the applicability of the provisions of Amendment Act 68 of 1984 in the context of land acquisition compensation. The Court held that since the reference Court had decided the matter in December 1973, the respondents were not entitled to the benefits of enhanced solatium and interest under Sections 23(2), 28, and 1-A of the Land Acquisition Act, 1894. The appeal was allowed to the extent that claimants were entitled to interest at 6% on the enhanced compensation and solatium at 15%, modifying the High Court's judgment accordingly.
